Bidding Announcement for Site Supervision of the Operation Zone (ZOP) and the Entrance Complex (CI) for Chancay Multipurpose Terminal New First Stage, Peru

1.1   Project Definition

COSCO SHIPPING Ports Chancay Peru S.A. (hereinafter referred to as “CSPCP” or “Employer”) is seeking a competent Site Supervision Consultant (hereinafter referred to as “Supervision Consultant”) to render site supervision service for the Operation Zone (ZOP) and the Entrance Complex (CI) for Chancay Multipurpose Terminal New First Stage (hereinafter referred to as “Project”), which has been endorsed by China COSCO SHIPPING Corporation Limited.

1.2   Project Overview and Scope of Services

1.2.1         Project Location

The Project is located in the Municipality of Chancay, Province of Huaral, Department of Lima.

1.2.2         Scale of the Project

The Employer, COSCO SHIPPING Ports Chancay Peru S.A, is going to develop a greenfield port infrastructure in Chancay Bay, Peru, where not only has an appropriate deep water to accommodate large seagoing vessels but also a good inland connectivity with the capital and other hinterlands.

The development of Chancay Multipurpose Port Terminal or TPMCH by its Spanish acronym is regarded an important investment in port infrastructure in recent years of Peru, which will greatly increase the handling capacity of cargo along the coast and catalyze the prosperity of regional economy. 

With the ambition, the port will be built into several stages and this tender is a start-up. In terms of the functions of different areas composed by TPMCH, there are three (3) main areas, Port Operating Zone (ZOP by its Spanish acronym), Entrance Complex (CI by its Spanish acronym), and a Tunnel & Access Road System which is the main access to and from the port. Within the tender, the Employer is soliciting a consultant to perform the supervision service of the contractor who will be entrusted by the Employer to construct the ZOP and CI, the Access Road System will be built by others.

In the New First Stage, one (1) primary breakwater and one (1) secondary breakwater with total length of 2,908m are to be built to provide shelter and tranquility for the port area. And totally four (4) main berths with a total berth length of 1,500m will be built for the port operator to handle containers, solid bulk, break bulk, rolling cargo and approximately 1.18 million sqm. land area will be formed and pA/Ved for stacking cargo and erecting various functional buildings. After completion, TPMCH is expected to be capable of handling 1 million TEU of container, 6 million tons of general cargo and 160,000 units of rolling cargo.

1.2.3         Planned Construction Period

The planned construction period is tentatively from 15th April 2021 to 15th October 2024 (Date of Commencement or Notice to Proceed subject to the Employer’s approval), with a total duration of 42 months.

1.2.4         Scope of Services

Site Supervision service shall cover all the scope of services of the Contractor during the construction period according to relevant laws, regulations and specifications. (For detail, please refer to Attachment 1: Scope of Site Supervision Services)

1.3   Requirements of Site Supervision Consultant

1.3.1         Qualification Requirements

1.3.1.1     International Certifications: Tenderers (or Leader Member in the case of Joint Venture) shall showcase evidence that is certified in ISO 9001, 14001 and OSHA 18001 or 45001; or equivalents in other countries.

1.3.1.2     Tenderers (or Leader Member in the case of the Joint Venture) shall present proof that it is DOMICILED in Peru, such proof are:

1) Tax ID Certificate issued by SUNAT (Peruvian Tax Authority) of the branch of the foreign company or of the company incorporated in Peru, issued with no more than 30 calendar days;

2) When it is a company incorporated in Peru (including the scenario of a subsidiary of a foreign company): Certificate of good standing of the company in Peru or the subsidiary (incorporated in Peru) of a foreign company issued by SUNARP (“Certificado de Vigencia de Persona Jurídica”), which must be issued with no more than 30 calendar days;

3) When it is a branch of a foreign company: Certificate of咨詢電話18811547188 good standing of the branch issued by SUNARP (“Certificado de Vigencia de Persona Jurídica”), which must be issued with no more than 30 calendar days;

4) If the company domiciled in Peru is a branch or subsidiary, in case this branch or subsidiary intends to use the performance and other qualification of its parent company, the parent company shall provide a written authorization to the Employer where clearly states its branch or subsidiary is authorized to use past performances of parent company. At the same time, the parent company must submit the sworn statement (please refer to Chapter VII) declares that the parent company will be responsible for all debts and other contractual obligations stipulated in the Contract.

1.3.1.3     Industry of Tenderer and Subcontractors:

The Tenderer or one member of JV shall demonstrate their qualification to carry out our project by submitting one of the documents as follows:

1) If the Tenderer from China: Class I Certification for Harbor and Waterway Engineering supervision issued by Ministry of Housing and Urban-Rural Development of the People’s Republic of China or Class I certification for Port and Waterway Engineering supervision issued by Transport Authority of the People’s Republic of China;

2) If the Tenderer from the other countries: Equivalent Professional Supervision Certification issued by relevant authority, together with the evidence of at least one site supervision contract within the latest 5 years for the works with its construction cost no less than 20 million Peruvian Soles (PEN) or equivalent foreign currency.

Tenderer shall list all their proposed subcontractors and their proposed roles, it′s mandatory that MOU between Tenderer and subcontractors must be submitted.

1.3.2         Tenderer Performance requirements

1.3.2.1     The Tenderer shall present evidence that demonstrates its participation of Site Supervision service on one (1) similar port (should include wharf construction) project since January 1, 2010 around the world. (Contract signing or project completion date is after January 1, 2010, contract copies affixed with official seal (including the page of signature and seal) or the project completion certificate shall be provided).

1.3.2.2     Plus, the Tenderer shall present evidence that demonstrate its participation of Site Supervision on one (1) mega infrastructure project in Peru since January 1, 2010 (Contract signing, or project completion date of the contract is after January 1, 2010, Contract copies affixed with official seal (including the page of signature and seal) or the project completion certificate shall be provided). Mega infrastructure project refers to the projects in the fields of ports, airports, roads, railways, bridges, tunnels, water supply, sewers, electrical grids, telecommunications.

1.3.3         Qualification requirements for the Project Manager of Supervision Consultant

The Proposed Project Manager for the Site Supervision shall hA/Ve at least fifteen (15) years of experience of supervising and at least one project working as Project Manager, Deputy Project Manager, or equivalent title within last ten (10) years for site supervision of a port (experience should include wharf construction) project around the world, (Contract signing, or project completion date of the Site Supervision Contract is after January 1, 2010). The Proposed Project Manager shall be registered in the Engineering Chamber of Peru (Colegio de Ingenieros del Peru), and hA/Ve the ability to communicate in English and Spanish.

Note: Supporting document such as copies of the contracts, completion certificate, correspondence from the Employer during the project implementation, or the certificate signed by the legal representative of the Employer affixed with official seal, must be provided. The supporting document shall reflect the time, types of the project, and name of the Project Manager.

1.3.4         Joint Venture

Joint Venture is acceptable.

The whole joint venture shall be treated as one Tenderer; and professional qualification and experience of any member of the joint venture shall be treated as qualification and experience of the whole joint venture. The qualified joint venture shall meet all the following requirements:

1.3.4.1     It is acceptable that up to three members to form the joint venture.

1.3.4.2     The responsibility and division of various parties in the joint venture must match their qualification and professional experience.

1.3.4.3     “Joint Venture Agreement” shall be submitted together with the proposals, and the agreement shall clearly stipulate Leader Member of the Joint Venture, stipulate authorized representatives of various parties of the Joint Venture, and define responsibilities and division of various parties, and declare that proposals and the contract signed shall be legally bound upon each member of the Joint Venture, and promise that in performance of the contract, various parties shall undertake their independent responsibility and mutual joint liability.

1.3.4.4     Neither any member of the Joint Venture shall participate in the tender alone in its own name besides Joint Venture, nor form a new Joint Venture or join in other Joint Venture (otherwise, the Proposals submitted by this member together with all Joint Venture(s) with its involvement will be rejected at the same time).

1.3.4.5     The JV must hA/Ve Peruvian Tax Id (RUC Number) before signing the Contract. If a JV is awarded of the contract, the created JV vehicle according to Peruvian law shall obtain the Tax ID after the Letter of Award before the execution of the Contract. In the event of any failure of obtaining the JV’s Tax ID within 15 days after issuing the Letter of Award, the JV is deemed waiver the identity of the awardee automatically.

1.3.4.6     Where signature and seal are required according to the Chapter VII Form of Tender, all the members of the Joint Venture should sign and affix the official seal.

1.3.5         Exclusions

The Tenderer that may affect the fairness cannot participate in the tender. If the legal representative of the Tenderer is the same person as the other Tenderer or different Tenderers hA/Ve management relationship, they may not participate in the tender. In violation of the above provisions, the relevant Tender proposals will be rejected.

1.3.6         Qualification evaluation Method

Post-qualification verification is adopted for this Tender.

1.4   Acquisition of Bidding documents

Interested Tenderers can register to obtain Bidding documents, and whether to form a Joint Venture to participate in the Tender shall be confirmed during the registration. In case of a Joint Venture, each company shall provide his registration documents and at the same time submit a letter of commitment specified the leading member of the Joint Venture.

1.4.1         The registration can be applied for in two ways below:

Option 1: Any interested party who intends to participate in the tender shall purchase the Bidding documents during 9:00 to 11:00 a.m., and 13:00 to 16:00 p.m. from February 3rd, 2021 thru February 9th, 2021 (Beijing Time unless otherwise stated) at 14/F, No. 358 Mei Li Yuan Building, West Yan An Road, Shanghai, China with the Letter of Authorization and the original ID card of the potential tenderer’s representative or consignee. The submittals in registration also include the supporting documents which prove the requirements stipulated in 1.3.1.1, 1.3.1.2, 1.3.1.3, 1.3.2 and all the aforementioned submittals shall be duly stamped by the potential tenderer.

Option 2: Any interested party can register and obtain the Bidding documents through email to the Tender Agency before 4p.m. from February 3rd, 2021 thru February 9th, 2021 (Subject to the time of receipt of the email) by sending the scanned copy of the above submittals listed in Clause 1.4.1. Tenderers shall guarantee the authenticity and validity of the scanned copy.

1.4.2         Cost of the Bidding documents

The Bidding documents are sold at a cost of RMB 3000 or USD 450 per copy and shall not be sold after the deadline of registration nor refundable after sale. The remittance accounts are as follows:

1.5   Submission of Tender Proposals

1.5.1         The deadline of proposals submission is 07:00 P.M, March 22nd, 2021, Lima Time (08:00 A.M, March 23rd, 2021, Beijing Time). The Tenderer shall send the Tender Proposals to Place for Proposal Opening before the deadline:

If the Option 1 cannot be proceeded, due to the severe COVID-19 situation, control policies and trA/Vel restrictions, Option 2 shall be applied at the instruction of Tenderee.

1.5.2         The Employer will not accept the Tender Proposals that hA/Ve been delivered late or hA/Ve not been delivered to the designated place.

1.6   Media of Announcement

1.6.1         This Tender Announcement is published on several websites including gs.coscoshipping.com, , and . At the same time, the Bidding Announcement will be sent to Consulate General of the Republic of Peru in Shanghai via email. Additionally, the Peruvian Chamber of Construction (CAPECO) will email the Bidding Announcement to their members. Any amendments related will published on .
